Lenders could be more sympathetic towards education loan defaulters, but legal action is always a possibility

In India, lakhs of students take education loans every year. Most preferred option is public sector banks, as these entities offer education loans at affordable interest rates. However, not every student may be able to repay their education loan. This presents the question, as to what happens when one defaults on their education loan. To know the answer, here are some important things to understand.

Willful vs. genuine default

Before taking any action, banks will first try to understand if the individual has willfully defaulted on the education loan or is facing a genuine problem. A willful defaulter is one who intentionally defaults on the education loan even when they may be having adequate money to repay the loan. If the bank identifies the individual as a willful defaulter, appropriate legal action can be taken after a specific timeframe.

In comparison, there could be cases where students may genuinely not be in a position to pay back their education loan. With education loans, students usually hope to complete their studies and get a job. But if they are unable to find a job and do not have any other financial backing, they may be unable to pay the education loan. In such cases, the lender can take a lenient view of the defaulter. The student may be granted more time to repay their loans without imposing any additional penalties.

What happens when you default on an education loan?

Bad credit score – Education loans are usually the first loans taken by an individual. And if there is a default, it will create a negative impact on the credit score and credit rating. When an individual defaults on their first loan itself, banks and financial institutions will treat such individuals as high risk. Such individuals may find it difficult to secure new loans or credit cards in the future. Challenges will be faced for all types of loans such as home loan, personal loan, car loan, etc.

Notice from the lender – When you default on your education loan, the lender will start sending you notices to pay your loan EMIs. These are usually gentle reminders, asking you to repay your loan. You will start receiving such notices after your first EMI default. The lender can also impose penalties, which would get added to the EMI amount.

Legal action – If you have not paid any EMI on your education loan for more than 180 days, the bank can initiate legal action under the Negotiable Instruments Act of 1881. It is likely that action will be taken as per the provisions of Section 138 of the Act. Under this section, the individual could face fine or imprisonment or both. Imprisonment can be for a term of up to 2 years.

If you are unable to pay your education loan, it is important to communicate your difficulties to the lender. You can request an extension of the EMI payment period. Depending on your situation, banks can also offer you easier options for loan restructuring. By keeping communication channels open with the lender, you can avoid legal troubles associated with your education loan default.

February 10, 2025 – Jaipur, India – NIMS University successfully organized an insightful workshop on “Design Thinking, Critical Thinking, and Innovation Design” in Collaboration with Nims Sushma Innovation and Incubation Center at the Axel Pries Institute of Public Health & Biomedical Science. The session was led by Dr. Sanjay Pattan Shetty, Director of the Institute, who shared deep insights into structured innovation, problem-solving, and the practical application of design thinking principles.

Why Innovate & When to Stop?

Dr. Shetty emphasized that innovation is the key driver of individual and societal progress, enabling solutions to real-world challenges. He highlighted that true innovation must address genuine problems and bring value to society. However, he also underscored the importance of recognizing when to halt innovation—if an idea is no longer viable or does not produce the desired results, further investment of time, money, and effort may lead to unnecessary losses. He illustrated this with the example of ultrasonic planes, where continued investment despite clear limitations led to significant financial setbacks.

The Innovation Process

Dr. Shetty explained that successful innovation begins with a thorough understanding of the target audience and their real needs. Engaging with people, identifying pain points, and ensuring the innovation adds value to society is crucial. He also emphasized that fields like global health offer significant opportunities for impactful innovation, where solutions can lead to substantial improvements in public well-being.

Key Features of Innovation

Dr. Shetty outlined three critical elements that define successful innovation:

  1. Desirability – The innovation must be something people truly want and find useful.
  2. Feasibility – It should be cost-effective and accessible to a broad audience.
  3. Viability – The innovation must align with existing policies to facilitate smooth execution and widespread adoption.

Stepwise Approach to Innovation Through Design Thinking

The workshop delved into a structured approach to innovation using Design Thinking, broken down into three key steps:

  1. Empathy & Problem Identification – Understanding peopleֱ needs and critically evaluating existing solutions to identify gaps.
  2. Prototyping & Testing – Developing and testing a working model to refine and validate the innovation’s effectiveness.
  3. Implementation – Scaling up the solution for maximum impact, ensuring it is sustainable and widely beneficial.

Engaging Q&A and Takeaways

The workshop concluded with an engaging interactive Q&A session, where attendees discussed the challenges of innovation, shared their perspectives, and explored ways to drive meaningful change. Dr. Shetty reiterated that innovation is not just about invention—it is a revolution that transforms the world by addressing real problems effectively.

  1. Strong Emphasis on Technology Aided Learning: Smart Classrooms are gradually becoming the norm. Most classrooms are now equipped with smart boards and other technology aided learning tools. The integration of technology in educational curriculums is only expected to further accelerate, especially with the governmentֱ push towards the National Education Policy (NEP) 2020, which emphasises technology adoption. The use of interactive learning portals and platforms have enhanced the overall learning experience for the students. Artificial intelligence (AI) and machine learning (ML) will continue to influence and enhance school curriculums, making them more effective and impactful for every individual student.  In 2025 this trend towards increased adoption of online learning platforms, virtual classrooms, and interactive content will continue to supplement traditional teaching methods, to create a learning model that is personalised to the individual needs and capabilities of various students. Additionally, gamification will continue to make learning more engaging and interactive, boosting student participation and retention. Thus, placing the student at the centre of the education model.

The hybrid model that allows students the to combine the personal attention of in-person classes with the flexibility of virtual classrooms will continue to grow. Supplementing in-person classrooms with on-demand learning, will help accommodate diverse learning styles and schedules. Besides, allowing students to learn at their own pace and reinforcing self-directed learning, the hybrid model allows children from different sections of society and those residing in remote locations to have access to the same quality education through virtual on-demand learning portals.

Inclusive Education:Schools are becoming increasingly mindful of the diverse student pool and the need to provide a nurturing and inclusive environment that allows every individual student to grow and thrive.  Technology, infrastructure, counselling, and tailored learning plans will play a vital role in supporting children with special needs, to succeed academically and be better equipped to meet the challenges of the real world. Schools will also need to work at creating a more enabling environment that is sensitive to the needs of these children.
  1. Focus on Skill DevelopmentWith the continued emphasis to better prepare students for the future work environment, skill-based education is expected to grow. Indiaֱ education system will continue to see an accelerated shift from traditional rote learning to a more holistic approach, focusing on practical skills that students can use in real-life scenarios. Schools will increasingly offer programs in coding, robotics, digital literacy, entrepreneurship, and vocational training. This also aligns with the recently introduced PM Internship Scheme which also emphasises the need for a more skill-based education curriculum to allow students to flourish in the real world beyond the classroom walls.
  2. Overall Wellness and Mental Health:Overall wellness, especially mental health is becoming an integral part of every school curriculum. As the pressures of academic performance and societal expectations continue to mount, there is a growing need to include meditation and daily reflection in every studentֱ daily routine. Mental health programs, counselling services, and stress management strategies will continue to be integrated into the curriculum and will be seen as essential to raising well-rounded, balanced, and resilient young adults.
